1. Definitions
- "Company," "We," "Us," "Our" refers to seawyio, operating yacht charter services in Thailand
- "Client," "You," "Your" refers to individuals or entities booking charter services
- "Charter" means the yacht rental service provided under these terms
- "Vessel" refers to the yacht or boat provided for the charter
- "Agreement" means these Terms & Conditions along with any booking confirmation
2. Acceptance of Terms
By accessing our website, making a booking inquiry, or using our charter services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our services.
All charter bookings are subject to these terms and any additional conditions specified in your booking confirmation. The booking party is responsible for ensuring all passengers understand and agree to these terms.
3. Eligibility and Requirements
3.1 Age Requirements
The person making a booking must be at least 18 years of age. Minors may participate in charters only when accompanied by a parent or legal guardian who assumes full responsibility for their conduct and safety.
3.2 Capacity to Contract
You confirm that you have the legal capacity to enter into this agreement and that all information provided during booking is accurate and complete.
3.3 Fitness to Participate
Passengers must disclose any medical conditions, physical limitations, or other factors that might affect their ability to safely participate in charter activities. We reserve the right to refuse service if we determine that a passenger's condition poses safety concerns.
4. Booking and Reservations
4.1 Booking Process
Charter bookings can be made through our website contact form, email, or phone. All bookings require written confirmation from us before being considered confirmed.
4.2 Booking Information
Clients must provide accurate information including names, contact details, number of passengers, preferred charter date and type, and any special requirements. You are responsible for updating us if this information changes prior to the charter.
4.3 Availability
Charter availability is subject to confirmation. We recommend booking at least two weeks in advance during high season (December-March) and one week for other periods.
5. Payment Terms
5.1 Pricing
Charter prices are quoted in Thai Baht (THB) and are valid for the specific charter date and type confirmed. Prices include vessel use, fuel, crew services, and provisions as detailed in the charter description. Prices do not include gratuities or special requests unless explicitly stated.
5.2 Deposit
A non-refundable deposit of 50% is required within 48 hours of booking confirmation to secure your reservation. The remaining balance is due 7 days before the charter date.
5.3 Payment Methods
We accept bank transfer and major credit cards. Payment processing may be handled by third-party providers subject to their terms of service.
5.4 Late Payment
Failure to pay the balance by the due date may result in charter cancellation without refund of deposit.
6. Cancellation and Refund Policy
6.1 Client Cancellations
- Cancellations more than 14 days before charter: Deposit forfeited, balance refunded
- Cancellations 7-14 days before charter: 75% of total charter fee forfeited
- Cancellations less than 7 days before charter: 100% of total charter fee forfeited
All cancellations must be made in writing via email.
6.2 Weather Cancellations
If we determine that weather or sea conditions make charter operation unsafe, we will offer the following options:
- Reschedule to another available date during your stay
- Full refund if rescheduling is not possible
Minor weather variations that do not affect safety may result in route adjustments rather than cancellation. These adjustments do not qualify for refunds.
6.3 Company Cancellations
We reserve the right to cancel charters due to mechanical issues, crew unavailability, or other circumstances beyond our control. In such cases, you will receive a full refund or the option to reschedule. We are not liable for indirect costs such as travel expenses.
7. Charter Operations
7.1 Captain's Authority
The captain has full authority over vessel operation and safety matters. All passengers must follow the captain's instructions regarding safety procedures, equipment use, and conduct aboard the vessel. The captain may terminate a charter without refund if passenger behavior endangers safety or violates these terms.
7.2 Route and Itinerary
While we maintain planned routes, the captain reserves the right to modify itineraries based on weather, sea conditions, or safety considerations. These adjustments are made in your best interest and do not constitute grounds for refund or compensation.
7.3 Departure Times
Charters depart at scheduled times. Late arrival may result in reduced charter duration without refund. We recommend arriving 15 minutes before departure time.
8. Passenger Responsibilities
8.1 Prohibited Conduct
Passengers must not:
- Bring illegal substances or engage in illegal activities
- Bring firearms or weapons aboard the vessel
- Engage in behavior that endangers themselves, other passengers, or crew
- Damage vessel property or equipment
- Interfere with vessel operation or crew duties
- Exceed vessel capacity limits
8.2 Alcohol Consumption
Moderate alcohol consumption is permitted. However, excessive intoxication that affects safety or conduct may result in charter termination without refund.
8.3 Property Damage
Clients are responsible for damage to vessel property caused by themselves or their guests. Repair or replacement costs will be charged to the booking party.
9. Liability and Insurance
9.1 Company Insurance
We maintain comprehensive marine insurance covering vessel operation, third-party liability, and passenger coverage as required by Thai maritime law.
9.2 Personal Travel Insurance
We strongly recommend that clients obtain personal travel insurance covering medical expenses, trip cancellation, and personal belongings. Our insurance does not cover personal items or individual medical costs.
9.3 Limitation of Liability
To the fullest extent permitted by law, our liability for any claims arising from charter services is limited to the amount paid for the charter. We are not liable for indirect, consequential, or punitive damages including lost vacation time, travel expenses, or emotional distress.
9.4 Assumption of Risk
Yacht charters involve inherent risks associated with maritime activities. By participating, you acknowledge and accept these risks including but not limited to sea conditions, marine life encounters, and physical activity-related injuries.
10. Intellectual Property
All content on our website including text, images, logos, and design elements is the property of seawyio or used with permission. You may not reproduce, distribute, or use this content without written authorization.
11. Privacy and Data Protection
Personal information collected during booking is handled according to our Privacy Policy. By using our services, you consent to data collection and use as described in that policy.
12. Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of Thailand. Any disputes arising from these terms or charter services will be subject to the exclusive jurisdiction of the courts of Surat Thani Province, Thailand.
13. Dispute Resolution
We encourage clients to contact us directly with concerns. Most issues can be resolved through open communication. If informal resolution is unsuccessful, disputes may be referred to mediation before pursuing legal action.
14. Force Majeure
We are not liable for failure to perform charter services due to circumstances beyond our reasonable control including natural disasters, government actions, civil unrest, pandemics, or other force majeure events. In such cases, we will work to reschedule or provide refunds as circumstances permit.
15. Modifications to Terms
We reserve the right to modify these Terms & Conditions at any time. Changes will be posted on our website with an updated "Last Updated" date. Bookings confirmed before changes remain subject to the terms in effect at the time of booking.
16. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. Invalid provisions will be modified to achieve the intent of the parties to the extent possible.
17. Entire Agreement
These Terms & Conditions, together with your booking confirmation and any referenced policies, constitute the entire agreement between you and seawyio regarding charter services. They supersede all prior discussions, understandings, or agreements.
